Au-Pair in Österreich
Leitfaden für Mitarbeiter des Arbeitsmarktservices

Es stellt sich heraus, dass das Arbeitsmarktservice seinen Mitarbeitern keinen zusammenhängenden Leitfaden mit den entsprechenden Gesetzen und Verordnungen zur Verfügung stellt, sondern auf das Rechtsinformationssystem des Bundeskanzleramtes  www.ris.bka.gv.at verweist.  Offensichtlich besteht ein Informationsmangel unter den Mitarbeitern des Arbeitsmarktservices, der deren Erledigungen erschwert bis vereitelt.


1.    Was ist ein Au Pair?

Au-pair nennt man junge Erwachsene oder in manchen Staaten auch Jugendliche, die gegen Verpflegung, Unterkunft und Taschengeld bei einer Gastfamilie im In- oder Ausland tätig sind, um im Gegenzug Sprache und Kultur des Gastlandes bzw. der Gastregion kennenzulernen.

Das Adjektiv dazu lautet au pair (französisch auf Gegenleistung). Es wird auch als Substantiv verwendet, um das abstrakte Konzept zu bezeichnen, und bleibt laut Duden in deutschen Texten in der französischen Form.

A)    Voraussetzungen: eigenberechtigt, Mindestalter 18 Jahre in Österreich
B)    Jugendliche aus der EU brauchen keinerlei Genehmigungen
C)    Jugendliche aus Nicht-EU benötigen ein Visum und dafür eine Anzeigebestätigung des Au-pair-Verhältnisses durch das AMS


2.    Was ist ein Au Pair nicht?

Es ist
a)    keine Arbeitskraft
b)    in der Regel biologisch nicht verwandt
c)    nicht asexuell
d)    kein/e Heilige/r
e)    Nur weil sie auf Kinder „schauen“, lieben sie diese noch lange nicht.


3.    Unterschied der Au Pair Intention aus Sicht des Herkunftslandes

a) Wenn die Tochter des Vorsitzenden des Österreichischen Forschungsforderungsfonds oder andere als Au Pair, in der Regel in den Westen – USA, Frankreich oder Norden – Skandinavien – gehen, dann ist das Motiv nicht, ein besseres Leben zu sehen und als Arbeitskraft tätig zu sein, sondern einen persönlichen Erfahrungsschatz zu gewinnen.

b) Für Au Pair aus dem Osten, mit Ausnahme Japans, schwingt sicher das Interesse, ein besseres Leben zu entdecken und sich sonst diese Reise und Erfahrung nicht leisten zu können, mit.

c)
ca) Gastfamilien in Österreich sehen Au Pairs aus dem Westen als vollwertige, erwachsene Menschen, die brauchen sich auch nicht durch die Beurteilung durch das Arbeitsmarktservice abwerten zu lassen.
 
cb) Au Pairs aus dem Osten werden, wie leider auch vom Arbeitsmarktservice, missverständlich so gesehen: als unterentwickelte, zurückgebliebene 20h- Wochenstunden verrichtende Kindermädchen, Hausmädchen.


4.    Was ist eine Gastfamilie?

Eine Gastfamilie besteht aus mindestens einer erwachsenen Person und einem Kind, aber es sind mitlebende, alte Menschen nicht ausgeschlossen.  


5.    Wie viele Au-Pairs pro Gastfamilie?

So viele, wie sich diese leisten kann und damit die Voraussetzung von Unterbringung, ein versperrbares Zimmer (auch dies steht nirgends und ist diese Vorschrift nicht gesetzlich nachvollziehbar) und Entlohnung etc. – siehe Kosten – mitbringt.


6.    Was ist der Inhalt einer Au-Pair-Vereinbarung?

a) Es ist kein Dienstverhältnis – wenn es ein Dienstverhältnis wäre, dann wäre bei Einhaltung der 434.Verordnung des Bundeseinigungsamtes beim Bundesministerium für Arbeit, Soziales und Konsumentenschutz, mit der der Mindestlohntarif für Au-Pair-Kräfte die Geringfügigkeitsgrenze überschritten, weshalb 66/01 Allgemeines Sozialversicherungsgesetz, § 49 Abs 3 Z 27 und Abs 8 die Au Pairs ausdrücklich als Dienstnehmer ausnehmen.
a)    Die Ausländerbeschäftigungsverordnung sieht keinerlei Beschreibung der Au-Pair Tätigkeit vor
b)    Aufgaben:
ba) In der Gastfamilie mit leben
bb) Sich persönlich, jedenfalls sprachlich, weiterentwickeln
 

7.    Kosten pro Monat

a)    483,50 Euro pro Monat (386,80 x 15 /12) Taschengeld – fälschlich als Entlohnung bezeichnet
b)    450;-- Euro Mietwert eines abschließbaren Zimmers
c)    300,-- Euro angenommene Kosten von Euro 10,- pro Tag Verpflegung
d)    12,91 Euro 155/2 = 77,50/6Monate = 12,91 Zuschuss Sprachkurs
e)    54,-- Euro Krankenversicherung
f)    Dienstkleidung
g)    Nebenkosten aller Art

8.    Rechtsgrundlagen in Österreich

a)    Ausländerbeschäftigungsverordnung §1 Abs 10

§ 1. Vom Geltungsbereich des Ausländerbeschäftigungsgesetzes sind ausgenommen:
   
10.Ausländer zwischen 18 und 28 Jahren für eine längstens zwölf Monate dauernde Beschäftigung als Au-pair-Kraft, welche die Gastfamilie zwei Wochen vor Beginn der zuständigen regionalen Geschäftsstelle des Arbeitsmarktservice angezeigt und für die das Arbeitmarktservice eine Anzeigebestätigung ausgestellt hat. Die Bestätigung ist binnen zwei Wochen mit einer Geltungsdauer von sechs Monaten auszustellen und kann um weitere sechs Monate verlängert werden, wenn die Au-pair-Kraft nicht unerlaubt vermittelt wurde, in den letzten fünf Jahren insgesamt nicht länger als ein Jahr als Au-pair-Kraft in Österreich beschäftigt war und weiterhin gewährleistet ist, dass das Ausmaß und der wirtschaftliche Gehalt der Tätigkeit dem eines Au-pair-Verhältnisses entspricht und insbesondere der Erwerb von Kenntnissen der deutschen Sprache nachgewiesen wird;

Entgelt
§ 49. (1) Unter Eltgelt sind die Geld- und Sachbezüge zu verstehen, auf die der pflichtversicherte Dienstnehmer (Lehrling) aus dem Dienst- (Lehr-) verhältnis Anspruch hat oder die er darüber hinaus auf Grund des Dienst- (Lehr-) verhältnisses vom Dienstgeber oder von einem Dritten erhält.

(2) Sonderzahlungen, das sind Bezüge im Sinne des Abs. 1, die in größeren Zeiträumen als den Beitragszeiträumen gewährt werden, wie zum Beispiel ein 13. oder 14. Monatsbezug, Weihnachts- oder Urlaubsgeld, Gewinnanteile oder Bilanzgeld, sind als Entgelt nur nach Maßgabe der Bestimmungen des § 54 und der sonstigen Bestimmungen dieses Bundesgesetzes, in denen die Sonderzahlungen ausdrücklich erfasst werden, zu berücksichtigen.

(3) Als Entgelt im Sinne des Abs. 1 und 2 gelten nicht:

Für Au-pair-Kräfte nach Abs. 8 neben dem Wert der vollen freien Station samt Verpflegung jene Beträge, die der Dienstgeber für ihren privaten Krankenversicherungsschutz und für ihre Teilnahme an Sprachkursen und kulturellen Veranstaltungen aufwendet-;

(8) Au-Pair-Kräfte im Sinne des Abs. 3 Z 27 sins Personen, die

- mindestens 18 und höchstens 28 Jahre alt und keine österreichischen StaatsbürgerInnen sind,
- sich zum Zweck einer Au-pair-Tätigkeit, die der Vervollkommnung der Kenntnisse der deutschen Sprache und dem Kennenlernen der österreichischen Kultur dient, in Österreich aufhalten,
- eine dem Hausgehilfen- und Hausangestelltengesetz unterliegende und höchstens zwölf Monate dauernde Beschäftigung im Haushalt einer Gastfamilie ausüben,
- in die Hausgemeinschaft aufgenommen sind und
- im Rahmen ihres Beschäftigungsverhältnisses Kinder der Gastfamilie betreuen.
- Sofern § 1 Z 10 der Ausländerbeschäftigungsverordnung, BGBl. Nr. 609/1990, anzuwenden ist, muss eine entsprechende Anzeigebestätigung des Arbeitsmarktservice und erforderlichenfalls eine gültige Aufenthaltsbewilligung vorliegen.

Das Bundeseinigungsamt beim Bundesministerium für Arbeit, Soziales und Konsumentenschutz ist gemäß § 22 Abs. 1 Arbeitsverfassungsgesetz, BGBl. Nr. 22/1974, in der Fassung des Bundesgesetzes BGBl. I Nr. 98/2012 ermächtigt, auf Antrag einer kollektivvertragsfähigen Körperschaft den Mindestlohntarif festzusetzen, wenn für den betreffenden Wirtschaftszweig kein Kollektivvertrag wirksam ist.

Das Bundeseinigungsamt beim Bundesministerium für Arbeit, Soziales und Konsumentenschutz hat mit Beschluss vom 7. Dezember 2012 nach Durchführung einer Senatsverhandlung nachstehenden Mindestlohntarif festgesetzt:

Geltungsbereich

§ 1. Dieser Mindestlohntarif gilt:
    1.    Räumlich: für das Bundesgebiet Österreich.
    2.    Fachlich und persönlich: für Arbeitnehmer/innen, die als Au-Pair-Kräfte gem. § 49 Abs. 8 ASVG beschäftigt werden.


Entgelt

§ 2. Der Au-Pair-Kraft mit Wohnung und Verpflegung bei Arbeitgeber/in (Gastfamilie) gebührt für die Tätigkeit als Au-Pair-Kraft (Kinderbetreuung und leichte Mithilfe im Haushalt) für eine Arbeitszeit von 20 Stunden inklusive Arbeitsbereitschaft ein monatlicher Mindestbruttobarlohn von 386,80 €.


Naturalbezüge

§ 3. Ist die Au-Pair-Kraft zur Inanspruchnahme einer vereinbarten Wohnung und Verpflegung nicht in der Lage (z. B. Dienstverhinderung durch Krankheit, Verzicht auf Dienstleistung während der Kündigungsfrist, bei begründetem vorzeitigen Austritt und bei unbegründeter fristloser Entlassung, Urlaub), so sind ihr/ihm diese Sachbezüge in Geld zu vergüten und zwar pro Kalendertag in Höhe eines 30stel des für die Bewertung von Sachleistungen für die Sozialversicherung festgelegten Bewertungssatzes.


Arbeitskleidung und Sprachkurs

§ 4. (1) Arbeitskleidung ist der Au-Pair-Kraft auf Kosten des Arbeitgebers/der Arbeitgeberin bei Dienstantritt in ordentlichem Zustand beizustellen. Die Reinigung ist vom Arbeitgeber/von der Arbeitgeberin zu veranlassen bzw. sind die dafür anfallenden Kosten von ihm zu bezahlen.

(2) Um dem Auftrag nach Vertiefung der deutschen Sprachkenntnisse einer Au-Pair-Kraft nachzukommen, hat der/die Arbeitgeber/in mindestens die Hälfte der Kosten eines Deutschkurses oder eines vergleichbaren Bildungsangebotes zu bezahlen.

(3) Die Kosten eines vom/von der Arbeitgeber/Arbeitgeberin angeordneten Kurses zur pädagogischen Qualifizierung sind vom/von der Arbeitgeber/Arbeitgeberin zu tragen.


Weihnachtsremuneration

§ 5. Der Au-Pair-Kraft gebührt in jedem Kalenderjahr eine jeweils am 1. Dezember fällig werdende Weihnachtsremuneration in der Höhe eines Bruttomonatsbarbezuges. Hat das Arbeitsverhältnis am Fälligkeitstag noch kein Jahr gedauert oder wurde es vor dem Fälligkeitstag aufgelöst, so gebührt der aliquote Teil der Remuneration.
Urlaubszuschuss

§ 6. Der Au-Pair-Kraft gebührt ein Urlaubszuschuss, der gemäß § 9 HGHAngG zu berechnen und fällig ist.


Abrechnungsnachweis

§ 7. Der/die Arbeitgeber/in ist verpflichtet, der Au-Pair-Kraft eine genaue mit Datum versehene Abrechnung über die geleisteten Arbeitsstunden, das Entgelt und die Abzüge bei der Entgeltauszahlung zu übergeben. Bei Arbeitsverhältnissen, die dem betrieblichen Mitarbeiter- und Selbständigenvorsorgegesetz, BGBl. I Nr. 100/2002, zuletzt geändert durch BGBl. I Nr. 35/2012, unterliegen, hat der Abrechnungsnachweis auch den Beitrag an die Betriebliche Vorsorgekasse sowie dessen Bemessungsgrundlage zu enthalten.


Wirksamkeitsbeginn

§ 8. (1) Dieser Mindestlohntarif tritt mit 1. Jänner 2013 in Kraft und gilt nur für Beschäftigungsverhältnisse von Au-Pair-Kräften, die nach dem 31.12.2012 abgeschlossen werden.

(2) Für Beschäftigungsverhältnisse von Au-Pair-Kräften, die vor dem 1.1.2013 abgeschlossen worden sind, ist weiterhin der Mindestlohntarif für Au-Pair-Kräfte, M 22/2011/XXV/99/1, BGBl. II Nr. 427/2011, anzuwenden.

Begriff
§2. (1) Arbeitsvermittlung im Sinne dieses Bundesgesetzes ist jede Tätigkeit, die darauf gerichtet ist, Arbeitsuchende mit Arbeitgebern (Dienstgebern) zur Begründung von Arbeitsverhältnissen (Dienstverhältnissen) oder mit Auftraggebern (Zwischenmeistern, Mittelspersonen) zur Begründung von Heimarbeitsverhältnissen im Sinne des Heimarbeitsgesetzes 1960, BGBl. Nr. 105/1961, zusammenzuführen, es sei denn, dass diese Tätigkeit nur gelegentlich und unentgeltlich oder auf Einzelfälle beschränkt ausgeübt wird.

Unter den Begriff Arbeitsvermittlung fällt auch die Vermittlung von Arbeitsuchenden und von Au-Pair-Kräften von Österreich in das Ausland und vom Ausland nach Österreich.

(2) Unentgeltlich im Sinne des Abs. 1 ist die Tätigkeit der Arbeitsvermittlung, wenn sie nicht auf Gewinn gerichtet ist und ohne sonstigen wirtschaftlichen Nutzen ausgeübt wird.

(3) Als Tätigkeit im Sinne des Abs. 1 gilt auch die Veröffentlichung und Verbreitung von Stellenangeboten und Stellengesuchen, es sei denn, dass diese nicht der Hauptzweck ist.

(4) Als Tätigkeit im Sinne des Abs. 1 gilt auch die Überlassung von Arbeitskräften zur Arbeitsleistung an Dritte, sofern der Überlasser nicht die Pflichten des Arbeitgebers trägt.

(5) Jede auf Arbeitsvermittlung gerichtete Tätigkeit, die den Vorschriften dieses Bundesgesetzes widerspricht, ist untersagt.

Österreich ist diesem Europäisches Übereinkommen über die Au-pair-Beschäftigung nicht beigetreten, dennoch gilt dieses auf Grund des österreichischen Vollbeitritts zur Europäischen Union und der Gültigkeit der EU-Grundrecht auch in Österreich

Zusammenfassung

Ziel dieses Übereinkommens ist es, gewisse Schwierigkeiten bei der Au-pair-Beschäftigung zu vermeiden. Zu diesem Zweck enthält es genaue Bestimmungen über die Beziehung zwischen der Gastfamilie und der Au-pair-Person (die weder als Arbeitnehmer noch als Student angesehen wird). Einige Bestimmungen sind bindend (z.B. das Erfordernis eines schriftlichen Vertrags, Regeln für die beiderseitigen Pflichten in Bezug auf Arbeitszeiten, Freizeit, Taschengeld usw.). Der Europarat hat ein Vertragsmodell für Au-pair-Beschäftigte ausgearbeitet.

2.    Pflichten des Arbeitsmarktservice
Diese Pflichten sind in der Ausländerbeschäftigungsverordnung § 1 Abs 10 erschöpfend aufgezählt, weitere Pflichten und Befugnisse sind ausgeschlossen.

1.    Prüfung ob Ausländer zwischen 18 und 28 Jahren
2.    Prüfung ob innerhalb der letzten 5 Jahre mehr als zwölf Monate bereits Au pair in Österreich
3.    Prüfung ob Anzeige zwei Wochen vor Beginn der Au Pair Tätigkeit der zuständigen regionalen Geschäftsstelle des Arbeitsmarktservice angezeigt wurde.
4.    Ausstellung einer Anzeigebestätigung binnen zwei Wochen mit einer Geltungsdauer von sechs Monaten
5.    Verlängerung der Anzeigebestätigung um weitere sechs Monate
6.    Prüfung ob die Au-Pair-Kraft nicht unerlaubt vermittelt wurde,
7.    Nach Ablauf von 6 Monaten, also nicht bei der Anzeigebestätigung der ersten 6 Monate, ob weiterhin gewährleistet ist, dass das Ausmaß und der wirtschaftliche Gehalt der Tätigkeit dem eines Au-Pair-Verhältnisses entspricht und insbesondere der Erwerb von Kenntnissen der deutschen Sprache nachgewiesen wird

Diese Bestimmung, laut hier 7. macht insofern Sinn,
a)    als damit ein Fortschritt bei einem Au-Pair festzustellen ist, womit eine eindeutige Abgrenzung zu einer Arbeitskraft gegeben ist, da bei einem Arbeitsverhältnis kein persönlicher Fortschritt Vertragsbedingung ist,
b)    da im Vorhinein dies naturgemäß nicht beurteilt werden kann

3.    Vertragsbeginn, Unterbrechungen, maximale Dauer
a)    Vertragsbeginn
aa)Vertragsbeginn ist frühestens ab Anzeigebestätigung des AMS oder
bb) Ablauf von 14 Tagen ab Anzeige ohne Ablehnung durch das AMS
cc) Tatsächlicher oder zumindest tatsächlich möglicher Vertragsbeginn
dd) Visumserteilung
ee) Einreise
ff) nach Wechsel ab Anzeigebestätigung oder Ablauf der 14 Tage-Frist gem Ausländerbeschäftigungsverordnung § 1 Abs 10
b)    Unterbrechung
Bei einem Wechsel der Gastfamilie bis zur Anzeigenbestätigung für eine neue Gastfamilie zählt dieser Zeitraum nicht zum einen Jahr, gemäß Ausländerbeschäftigungsverordnung § 1 Abs 10
c)    Dauer ist ein Jahr, wobei die Zeiträume der Unterbrechungen, wie zwischen verschiedenen Gastfamilien, nicht einzurechnen sind.
d)    Zeiten außerhalb von 5 Jahren werden nicht einberechnet


4.    Angelegenheiten, die nicht in die Zuständigkeit des Arbeitsmarkservices fallen
a)    Aufsicht über die Einhaltung von Vertragsbestimmungen des Au-Pair-Verhältnisses vor oder während der ersten 6 Monate und nach neuerlicher Anzeigebestätigung für die weiteren 6 Monate – dies ist Aufgabe der Arbeitsgerichte oder der Bezirksverwaltungsbehörde.
b)    Art der Dienstkleidung


Problemstellungen für die Gastfamilie

1.    Kindesmisshandlung
Es ist eine Vertrauensstellung, einen Fremden mit leben zu lassen und daher eine besondere Vorsicht walten zu lassen.
2.    Kindesmissbrauch
Es ist eine Vertrauensstellung, einen Fremden mit leben zu lassen und daher eine besondere Vorsicht walten zu lassen.
3.    Ehebruch
Au-Pairs sind in voller sexueller Blüte und von Piech-Porsche beginnend neue Familiengründungen mit dem Vater in der Au-Pair Familie sehr häufig.
4.    Alkohol
Speziell mongolische Au Pairs, aber nicht nur diese, neigen zu Alkoholmissbrauch.
5.    Schadensverursachend
Ein Au-Pair hat eine Vertrauensstellung und damit eine großen Spielraum, Schaden von exzessiven Telefonrechnungen über mitgenommene Silberlöffel zu verursachen.
6.    Fremde Personen
Nachdem Au-Pairs von 18 bis 28 biologisch in voller sexueller Blüte stehen, ist es nichts Außergewöhnliches, dennoch äußerst unangenehm, wenn fremde Männer, oft in Horden, unter Missbrauchs des Postschlüssels der Haustüranlagen mitten in der Nacht vor der Wohnungstüre stehen und die Au-Pair aufsuchen wollen, oder Männer aller Art auf dem Handy der Gastfamilienmitglieder zu allen Tages- und Nachtzeiten, in teilweise unfassbarem Ton, anrufen, und begehren, mit der Au-Pair verbunden zu werden.


Annex

Au Pair Allgemeines

Ein Aufenthalt als Au-pair ermöglicht jungen Menschen mit geringem Geldaufwand, einen anderen Sprach- und Kulturraum kennenzulernen. Diese Art des Aufenthalts wird eher von Mädchen und jungen Frauen genutzt, während Jungen eher andere Möglichkeiten, wie den Schüleraustausch, vorziehen.

Die Aufgaben eines Au-pairs liegen hauptsächlich in der Kinderbetreuung, die manchmal auch beinhaltet, den Kindern die Sprache des Au-pairs näher zu bringen. Zudem wird eine „leichte Mithilfe“ im Haushalt erwartet. Die Gastfamilie übernimmt dafür die Kosten für Unterkunft und Verpflegung und zahlt zusätzlich ein Taschengeld.

Der Aufenthalt als Au-pair fördert unter anderem die
•    Erweiterung des eigenen Erfahrungshorizonts;
•    Verbesserung der Fremdsprachkenntnisse;
•    Vorbereitung auf einen längeren Aufenthalt im Ausland;
•    Erfahrungen im Umgang mit Kindern und der Haushaltsführung.


Aufgaben

•    Kinderzimmer und eigenen Raum säubern und aufräumen
•    kleine Einkäufe erledigen


Missbrauch und Gegenmaßnahmen

Fälschlich wird das Au-pair gelegentlich als Haushaltshilfe bezeichnet. Es handelt sich auch nur bedingt um ein Arbeitsverhältnis, auch wenn beispielsweise in Deutschland eine Reihe von entsprechenden arbeits- und sozialrechtlichen Regelungen gilt. Meist ist im Falle von Au-Pairs von einem „Betreuungsverhältnis besonderer Art“ die Rede.
Mitunter wird die Grenze für die Maximalarbeit ausgeweitet, in einigen Fällen bis hin zu Ausbeutung und Missbrauch, womit dann gleichermaßen ein illegales Beschäftigungsverhältnis begründet wird.

Der Bericht der Bundesregierung über die Situation und Entwicklung der Au-pair-Vermittlung vom 27. Januar 2005 berichtete unter anderem über die Umsetzung der Forderungen des Deutschen Bundestages zur Verhinderung von Missbrauch.

Um illegalen Arbeitsverhältnissen und Missbräuchen der als Au-pair in Deutschland beschäftigten vorzubeugen, wurde in Deutschland mit Unterstützung des Bundesministeriums Familie, Senioren, Frauen und Jugend ein RAL-Gütezeichen Au-pair entwickelt. Vermittler, die dieses tragen, verpflichten sich zur Kontrolle der Einhaltung aller Au-pair-Standards bei Familien und Au-Pairs. Dies wiederum wird von dritter Seite neutral überwacht.


Integration in die Familie

Von Seiten der Familie und des Au-pair können unterschiedliche Erwartungen über das Zusammenleben in der Familie bestehen. Au-pair-Agenturen versuchen meist im Vorfeld, über Fragebögen festzuhalten, was sich Au-pair-Kandidaten und Familien wünschen, welche Gegebenheiten und Wünsche bezüglich Rauchen und eventuellen Haustieren bestehen, ob dem Au-pair ein eigenes Bad, eine Stereoanlage oder ein Fernseher im Zimmer zur Verfügung stehen werden und ob es dem Au-pair erlaubt sein wird, Freunde nach Hause einzuladen. Viele Au-Pair Agenturen sehen zusätzliche Bedingungen in dem von ihnen vorgedruckten Au-pair-Vertrag vor, um so eine Absprache zwischen der gastgebenden Familie, dem Au-pair und der Agentur zu bewirken. Neben den formellen Absprachen ist eine gut funktionierende Kommunikation von wesentlicher Bedeutung.

Das Ineinanderfallen von Arbeits- und Lebensort ist für Au-Pairs, wie auch für live-in Haushaltshilfen, ein besonderes Problem.

Grundsätzlich sind Rücksichtnahme, gegenseitiges Wohlwollen, Geduld, Takt, Warmherzigkeit und bei Problemen eine diplomatische Sprechweise erforderlich; stets spielen aber auch Charaktereigenschaften und unausgesprochene Erwartungen eine wichtige Rolle.

Im Idealfall fühlen sich die Au-pair, die Kinder und die Gasteltern miteinander wohl, das Au-pair hilft wirksam bei der Kinderbetreuung und bei kleineren Aufgaben im Haushalt mit, verbessert seine Sprachkenntnisse und lernt die Landeskultur besser kennen. Unter Umständen entsteht aus einem Au-Pair-Verhältnis eine persönliche Beziehung, die Jahre über die Au-Pair-Zeit hinaus bestehen bleibt.

Eine Gastfamilie und ihr Au-Pair sind sich nicht immer einig darüber, welche Hilfen gegenseitig benötigt werden und welche gewährt werden sollen. Für Au-Pairs ist beispielsweise die Internet-Telefonie, sei es von zuhause aus oder in einem Internet-Café, eine willkommene Möglichkeit, Kontakt mit der eigenen Familie und den Freunden im Heimatland zu wahren. Gasteltern können sich aber überfordert sehen, wenn das Au-Pair von ihnen den Zugang zum familieneigenen Computer und die Installation bestimmter Software, das Ausleihen und die Instandhaltung eines funktionstüchtigen Fahrrads und anderer Gebrauchsgegenstände beansprucht. Andererseits mag es Gastfamilien offensichtlich erscheinen, dass ein Au-Pair neben den in seinem Zimmer zur Verfügung gestellten Geräten auch elektronische Geräte in der Küche (Herd, Kühlschrank, Wasserkocher, Mikrowelle usw.) und die Waschmaschine benutzt, nicht aber beispielsweise die familieneigene Stereoanlage. Das Au-Pair kann jedoch ganz andere Vorstellungen und Erwartungen haben oder die Verwendung bestimmter Geräte nicht kennen, sodass Absprachen und Erklärungen nötig sind. Das Au-Pair befindet sich in der schwierigen Situation, dass es nicht von vornherein weiß, welche seiner Bitten eine Belastung für die Familie darstellen. Umgekehrt empfinden viele Au-Pairs die Anforderungen der Gastfamilie und insbesondere einen überhöhten Einsatz in der Hausarbeit oder einen Mangel an Zeitautonomie als Ausbeutung. Neben Sprachschwierigkeiten treten leicht durch Kulturunterschiede bedingte Missverständnisse auf. Au-Pairs wollen ihren Unmut oft nicht innerhalb der Gastfamilie äußern, da sie stark von der Atmosphäre innerhalb der Familie abhängig sind. Au-Pair-Agenturen stehen zwar grundsätzlich für Hilfestellungen bereit, sie bereiten die Beteiligten nicht notwendigerweise auf das reale Zusammenleben vor:

•    Manchem Au-pair wird es nicht klar sein, dass es wichtig ist, bei jeglichem in der Abwesenheit der Familie aufgetretenen Problem die Familie sogleich zu informieren. Wenn die Familie den Eindruck hat, dass ein Au-Pair aus Furcht verschweigt, dass ein Schaden oder ein Problem aufgetaucht ist, kann dies die Vertrauensbasis zwischen Familie und Au-Pair untergraben.

•    Aus unterschiedlichen Vorlieben beim Essen und Kochen sowie aus Kleinigkeiten, wie der Verwendung von Parfüm oder Deodorant-Sprays und die Art und Häufigkeit von Telefonanrufen, können sich Konflikte ergeben.

•    Idealerweise ist vor Vertragsschluss geklärt, ob die Familie möchte, dass das Au-pair beispielsweise über Weihnachten oder über die Sommerferien in das Herkunftsland zurückfährt und in welcher Höhe sich die Familie gegebenenfalls an den entstehenden Reisekosten beteiligt. Wenn die Familie erwartet, Weihnachten „unter sich“ zu verbringen, kann dies für ein Au-Pair, das von weit heran gereist ist, zu einer unzumutbaren finanziellen Belastung werden, zumal die eigene Herkunftsfamilie womöglich bei jedem Besuch mitgebrachte Geschenke erwarten würde. Für eine Gastfamilie ist es aber schwer, vor Antritt des Au-Pair-Verhältnisses vorherzusehen, ob sich mit dem betreffenden Au-Pair eine derart entspannte Familiensituation ergeben wird, dass eine gemeinsame Feier von Familienfesten oder ein gemeinsamer Urlaub angenehm sein wird.

Die zu beobachtende Bildung von Netzwerken, in denen sich Au-Pairs austauschen können, stellt für Au-Pairs eine Möglichkeit dar, die eigene Situation in Perspektive zu setzen.

 
Au-pair in Deutschland


Ein Au-Pair ist auch in Deutschland kein Hausangestellter. Die Maximalmithilfe eines Au-Pairs in Deutschland ist auf 30 Wochenstunden gesetzlich eingeschränkt, dies schließt Babysitting ein. Der Verband berufstätiger Mütter betont, dass ein Au-Pair nicht als Ersatz für eine qualifizierte tägliche Betreuung in einer Kindertagesstätte oder bei einer Tagesmutter angesehen werden kann, da dem Au-Pair die notwendige Erfahrung fehlt und gesetzlichen Bestimmungen die tägliche Arbeitszeit eng begrenzen.

Ein Au-pair darf zum Zeitpunkt der Visumsbeantragung zwischen 18 und 24 Jahre alt sein und maximal 1 Jahr in Deutschland bleiben. Ausreichende Kenntnisse der deutschen Sprache sind erforderlich. Die Anreisekosten bis zur Gastfamilie und zurück trägt das Au-pair.
Ein Au-pair erhält mindestens 260 Euro Taschengeld pro Monat, eine Kranken- und Unfallversicherung, kostenlose Unterbringung in einem eigenen Zimmer und alle Mahlzeiten. Dabei sitzt das Au-pair beim Essen mit am Familientisch und bekommt dasselbe zu essen wie die Gastfamilie; ein Au-pair hat hierbei also vollen Familienanschluss.

Jedes Au-pair bekommt die Möglichkeit, in seiner Freizeit an einem Deutsch-Sprachkurs teilzunehmen sowie kulturelle und geistig anregende Veranstaltungen zu besuchen.

Das Au-pair hat Anspruch auf einen freien Nachmittag und einen ganzen freien Tag pro Woche (jedoch Anspruch auf alle Mahlzeiten an freien Tagen) und auf Urlaub, der für ein volles Jahr 4 Wochen beträgt bzw. auf dieser Basis anteilig zu berechnen ist.


Au-pair in den USA

Die Maximalmithilfe eines Au-Pairs in den USA ist auf 45 Stunden/Woche bzw. 10 Stunden/Tag bestimmt.

Aufgaben eines Au-Pairs in den USA sind die Kinderbetreuung und damit verbundene Arbeiten wie z. B. Mahlzeiten für die Kinder zubereiten, Spielsachen aufräumen, Wäsche der Kinder waschen, Kinder zu Aktivitäten fahren und abholen. Das Au-pair ist nicht für allgemeine Hausarbeit (z. B. Kochen, Putzen, Waschen für die Gasteltern) zuständig, sondern ausschließlich für Tätigkeiten, die mit den Kindern zu tun haben.

Weitere von der US-Regierung festgelegte Bedingungen
•    1½ Tage frei pro Woche und mindestens ein freies Wochenende im Monat (von Freitag Abend bis Montag Morgen)

Das Au-Pair-Programm in den USA muss mindestens ein Jahr dauern (Ausnahme Sommer-Au-pair). Für die Teilnahme an einem Au-pair-Programm muss das sogenannte J-1 Visum beantragt werden. Dieses Visum erhält man in Deutschland nur über eine Au-pair-Organisation.


Au-pair in China

Die Regelungen über die Dauer und die Bedingungen eines Au-pair Aufenthaltes in China sind noch nicht so streng reglementiert wie in den meisten westlichen Staaten, es gibt 3-, 6- und 12-monatige Programme.

Das Konzept ist für China noch sehr neu und es gibt nur wenige Agenturen, die einen Aufenthalt vermitteln. Die Aufgaben eines/r Au-pairs in China beschränken sich im Wesentlichen auf Sprach- und Kulturaustausch. Da es nur relativ wenige ausländische Bewerber gibt und einen großen Bedarf, sind die Anreize entsprechend hoch.

Au-Pair-Konvention des Europarates

Das „Europäische Übereinkommen über die Au-Pair-Beschäftigung“ wurde am 24. November 1969 durch den Europarat angenommen und am 2. Oktober 1976 von Deutschland unterzeichnet, harrt allerdings noch der Ratifizierung.

Au-Pair Verhältnisse unterliegen in Deutschland weder der Lohnsteuer noch der Sozialversicherung. Steuerzahlende Gasteltern können Aufwendungen für ein Au-pair (Taschengeld, Kranken-, Unfall- und Haftpflicht-Versicherung, Monatskarte für öffentliche Verkehrsmittel, Verpflegung, Nebenkosten für Strom und Wasser) steuerlich zumindest teilweise geltend machen, wenn sie die Kosten nachweisen. Insbesondere muss ein Au-pair-Vertrag vorliegen. Das Finanzamt erkennt dabei keine Barzahlungen an, sondern nur Überweisungen.


Gesellschaftlicher Kontext (Deutschland)

In Deutschland waren die Zahl der Au-pair Anträge und die Zahl der gewährten Au-pair Visa ab 2003 stark rückläufig, wohingegen die Nachfrage gleichbleibend hoch blieb beziehungsweise anstieg. Vor allem aus neueren EU-Staaten Polen, Litauen, Lettland, Estland, Tschechien, Slowakei und Ungarn kamen seit ihrem EU-Beitritt weniger Bewerbungen. In diesem Zusammenhang forderte die Gütegemeinschaft Au pair e.V. im Jahr 2007 attraktivere Rahmenbedingungen für Au-pairs sowie Erleichterungen bezüglich der Visumvergabepraxis, mit der Begründung, dass das Au-pair Programm vom BMFSFJ als eine Facette im Angebotsspektrum der Kinderbetreuung zur Vereinbarung von Familie und Beruf anerkannt habe und es zugleich der Völkerverständigung diene. Auch die Au-Pair Society e.V. kritisierte 2009 die deutsche Visapolitik gegenüber Au-pair Bewerbern: die Kriterien zur Erteilung eines Visums seien in den vorangehenden Jahren erheblich erschwert worden, und insbesondere die Anforderungen an die Sprachkenntnisse seien zu hoch. Die FDP stellte im Juni 2008 einen Antrag an den Deutschen Bundestag, der unter anderem erleichterte Bedingungen und teils schnellere Bearbeitung von Au-pair Anträgen vorsah. Dieser Antrag wurde am 2. Juli 2009 abgelehnt.






European Agreement on "au pair" Placement
(ETS No. 68)

I. The European Agreement on "au pair" Placement, drawn up within the Council of Europe by the Social Committee, was opened for signature by the member States of the Council of Europe on 24 November 1969.

II. The text of the explanatory report of this Agreement does not constitute an instrument providing an authoritative interpretation of the text of the Convention although it might be of such a nature as to facilitate the application of the provisions therein contained.
General considerations

The European Agreement on "au pair" Placement comprises:
- a preamble,
- 22 articles,
- 2 annexes, the first of which sets forth the benefits to which persons placed "au pair" will be entitled in case of illness, maternity and accident, and the second concerns the agreed reservations,
- an appended protocol.

The Council of Europe's action attempts to help settle a problem of ever-increasing magnitude, as the number of young persons going abroad to improve their knowledge of languages has risen constantly since the end of the Second World War. School and university exchanges, study grants, holiday visits arranged by schools or youth organizations no longer suffice, despite their continual expansion, to satisfy young people's desire to widen their horizons, to know other countries or other ways of life.

"Au pair" placement, which has existed for a long time, is therefore particularly popular for it enables them to get to know a country thoroughly without too much cost and even, in the case of adolescents, without their family having to keep them during the placement period.

But although that form of placement is not new, its nature has changed. Arranged in the past on a friendly basis between families known to each other, or through mutual acquaintances, it has now become a unique social phenomenon because of the frequency and large number of persons involved. It is now by tens of thousands that the candidates travel throughout Europe and it is quite obvious that the uncontrolled development of such temporary migration cannot be allowed to continue if only in the interests of the parties concerned. Hence the need to seek a solution of this international problem by international regulation in the case in point, a European agreement.


Background
 
In November 1964, Mrs. Hubert and others tabled in the Consultative Assembly of the Council of Europe a motion for a recommendation on "au pair" employment. After the motion had been examined by the Social Committee, a report (Doc. 2072) was submitted to the Consultative Assembly which, at its sitting of 29 September 1966, adopted a recommendation to which were attached "Draft rules on 'au pair' employment". The recommendation, as No. 468 (1966), was transmitted to the Committee of Ministers.

In the meantime, at the end of 1965, the Committee of Ministers had included, in the 1966 Intergovernmental Work Programme of the Council of Europe the same subject under the heading: "Living and working conditions of 'au pair' girls : preparation of a convention".
The work to be done on that item in the Work Programme was entrusted to the governmental Social Committee which set up a sub-committee composed of experts from the principal home and receiving countries of the young people seeking "au pair" posts. In 1967, the sub-committee prepared a draft convention which was submitted to its parent body. The latter amended the text and transmitted it to the Committee of Ministers who, after discussing it on several occasions, decided to open it for signature in October 1969 in the form of a European Agreement.

Comments on the provisions of the Agreement
Preamble

The text of the preamble to the Agreement is largely the same as that usually adopted for Council of Europe conventions and agreements.

The first recital of the preamble is a direct reference to Article 1 of the Statute of the Council of Europe, regarding the aims of the Council; at the same time, the paragraph emphasizes the social motives which prompted the preparation of the Agreement.

The fourth recital stresses the international and European nature of the problem of "au pair" placement.

The fifth recital is of particular importance in relation to Article 2 of the Agreement (cf. comments below on that article).

The seventh recital stresses that one of the principal preoccupations in preparing the Agreement was the interest attaching to the moral protection of "au pair" persons in so far as they were still under age.

The eighth recital emphasizes the public authorities' role in guaranteeing and controlling the application of the principles set forth. It is a precursor to Articles 4, 6, paragraph 2, 12 and 13.


Article 1 – The general scope of the obligations of the Contracting States.

This article indicates the extent to which the Contracting States are bound by virtue of the Agreement.

The text of this article was drafted to make the Agreement as flexible as possible, so that account might be taken of situations prevailing in each country and thereby offer the greatest number of States the opportunity of ratifying the Agreement. In that respect, Article 1 is based on the formula appearing in certain ILO Conventions according to which the method of implementing these conventions should take account of national situations.

Despite the words "to the greatest extent possible" given in this article, it comprises more than a mere moral obligation. In fact, it compels the Contracting States to take all possible measures in the form not only of regulations but also of legislation. The word "possible" should therefore be taken to mean that each Contracting State must take whatever measures are necessary, unless it is impossible to do so for legislative, parliamentary or administrative reasons, or because of the existence of an objective situation. If, for example, it were objectively impossible in a Contracting State to take the measures required under the Agreement, the absence of such measures would not constitute a violation of the instrument.


Article 2 – Definitions

This article sets forth the definitions necessary to the interpretation and application of the other provisions in the Agreement.

Paragraph 1
This paragraph gives a general definition of "au pair placement" within the meaning of this Agreement.

It shows that the form of placement envisaged is more restricted than the general definition. Whereas "au pair" placement might be defined as consisting of reception (that is to say board and lodging) in return for services, it is here specified, among other things:
- that the "au pair" placement must be of a "temporary" nature,
- that its purpose must be cultural,
- that the persons placed must be foreigners,
- and that the placement must be made in families.

As regards the last point, it should be pointed out that the Agreement is not applicable to placements in institutions or collective bodies.

As regards persons covered, considering that there was no call to make a discrimination by seeking to protect young women only and that certain tasks, such as the supervision and intellectual training of children, were suitable to young men, the negotiators of the Agreement conceived the text as applying to young men and women, while at the same time recognising that the latter formed the great majority of the beneficiaries. Nevertheless, taking account of the fact, among others, that in certain countries "au pair" placement is not considered suitable for young men who would be better advised to find work, for example, as trainees, the Contracting Parties have the possibility of entering a reservation to exclude young men from the Agreement's scope of application. (cf. Annex II (a).)

In order to determine the purport of this paragraph it is also important to take account of the fifth recital in the preamble where it is stated that "persons placed 'au pair' belong neither to the student category nor to the worker category but to a special category which has features of both ...".

Paragraph 2
In referring to the previous paragraph, this paragraph defines the meaning of the term "persons placed au pair" used in Article 3, et seq. of the Agreement.
It is important to note that so far as its application to persons is concerned, the Agreement is not confined to nationals of the Contracting States ; the Agreement's provisions apply to any person placed "au pair" in the territory of any Contracting State without discrimination as to that person's nationality.


Article 3 – Duration of the "au pair" placement

Under this article, the 'au pair" placement may comprise
- an initial period of not more than one year,
- one or several extensions.
The aggregate of those periods (initial and extension(s)) may not however exceed a maximum of two years.

By limiting the maximum duration to two years, emphasis was placed on the temporary nature of the placements as set forth in Article 2, paragraph 1.


Article 4 – Age of persons placed "au pair"

Article 4, which has two paragraphs, sets forth certain age limits to be respected as regards "au pair" placement within the meaning of this Agreement.

Paragraph 1
This paragraph puts the general principle that a person placed "au pair" shall not be less than 17 nor more than 30 years of age.

- as regards the lower limit of 17 years: by bearing in mind that below that age school exchanges play a primary part and people are not generally mature enough to be placed "au pair" ;
- as regards the upper limit of 30 years : by bearing in mind the length of studies and the fact that, over that age, one was departing from the original purpose, i.e. the protection of young persons going abroad to improve their knowledge of languages.

It was noted that a Contracting State could specify a higher minimum age, or make admissibility of an "au pair" Placement, in view of the youth of the person concerned, depend on compliance with certain special conditions. For example, a Contracting State could make a regulation under which only young foreigners of at least 18 years of age would be eligible for "au pair" placement, and requiring, in the case of a 17 year old, the presence in that State of a legal representative.

Paragraph 2
This paragraph provides for an exception to the general rule set out in paragraph 1 of Article 4. However, the exception concerns only the upper age-limit of 30 years. Indeed, paragraph 2 of Article 4 lays down that "exceptions to the upper age-limit may be granted by the competent authority of the receiving country in individual cases when justified". Provision was made for the possibility of derogating from the upper age-limit in order to enable those persons wishing to undergo retraining to benefit, where applicable, from regulations on "au pair" placement. It takes account of the fact that studies are lasting longer and longer. On the other hand, there is no possibility of derogating from the lower age-limit, which places anyone below 17 years of age outside the Agreement's scope of application and should discourage such persons from seeking "au pair" placements.
 
The "competent authority" mentioned in paragraph 2 of Article 4 is the same as the one mentioned in Article 6, paragraph 2 and Article 12. It is a single authority appointed or instituted by the government of each Contracting State.


Article 5 – Medical certificate

This article provides that every person placed "au pair" shall have a medical certificate. It must be established less than 3 months before the placement and state the person's general state of health. It was agreed that the medical certificate would guarantee that the person concerned was not suffering from any infectious disease.

At one of the initial stages of preparing the Agreement, it was intended to replace the words "certificate... declaring that person's state of health", appearing in the final text of Article 5, by the phrase "certificate... declaring fitness to participate in day-to-day family duties". In the end, that drafting was not adopted for it appeared difficult to define what was meant by "day-to-day family duties".


Article 6 – Written agreement between the person placed "au pair" and the receiving family

It is important than the "au pair" person and the receiving family are clear about the rights and obligations arising from the arrangement they make. That is why a written undertaking is essential.

Article 6, composed of two paragraphs, specifies the form and other aspects of the written agreement between them which must therefore be the basis of any "au pair" placement.
The nature of that agreement was discussed at some length, some wishing it to be considered as an actual contract of employment, others not being able to accept that because, among other things, of strict regulations on the immigration of workers.

Moreover, once the principle of an agreement had been accepted, a compromise had to be found between two tendencies apparent at the outset of the preparatory work on the Agreement, namely that:

- it would be inadvisable to provide for the conclusion of a written agreement, mentioned in Article 6, before the person wishing to be placed "au pair" had left his country and had been in touch with the receiving family ; and
- it would be preferable to provide for the establishment of a document defining the conditions of the placement and authenticated, where applicable, by the competent authority before the person concerned commenced his activities and even before he had left his country of origin.

The compromise finally reached between those two tendencies was the adoption of a clause providing for the conclusion of a written agreement before the beginning of the placement "and at latest during the first week of the placement" (cf. Article 6, paragraph 1 in fine). The main advantage of this formula is to provide for a trial period before making the written agreement mentioned in Article 6. However, in order that those States which so desire might continue to require the prior conclusion of the written agreement, it was agreed that a Contracting Party could stipulate that this agreement be concluded before the "au pair" person left his country of residence (cf. Annex II (b)). A model agreement, prepared by the Council of Europe is reproduced here (Model text (Word format only)).

Paragraph 1
Among other things, this paragraph lays down
- that the purpose of the agreement provided for in Article 6 should be to determine "the rights and obligations of the person 'au pair' and the receiving family" in accordance with the Agreement ;

- that it should be in writing and consist either of one document or of an exchange of letters ;
- that it must be concluded, in principle, prior to the placement (cf. however, in that respect, the comments given on the preceding paragraph in the present explanatory report).
 
At one stage it was contemplated that the words mentioned above ("and the receiving family") should be replaced by the phrase "and of the member of the receiving family competent according to national legislation". However, that expression finally appeared less appropriate than the first, which stresses the importance of the general attitude of the receiving family.

As regards the phrase "parties in question", it should be specified that such persons must be determined by the relevant national legislation. The negotiators of the Agreement considered it preferable not to settle that question in the text itself, chiefly because of the many difficulties raised by the divergence of views on the definition of "minors".

Paragraph 2
The basis of this paragraph is that the Contracting Parties must organise the control of agreements by providing for a copy of the written agreement mentioned. in paragraph 1 to be lodged "with the competent authority or the organisation chosen by this authority".
The "competent authority" mentioned in this paragraph is the same as that mentioned in paragraph 2 of Article 4 and in Article 12 ; the "organisation" is one of the public or private bodies entitled to deal with placement mentioned in Article 12.
It was agreed that the receiving family need not itself deposit a copy of the written agreement with the competent body; this may also be done by a third party or the "au pair" person concerned.


Article 7 – General conditions of placement to be specified in the written agrement

This article lays down that the general conditions of each "au pair" placement must be set forth in the written agreement mentioned in Article 6.

The text should therefore specify the services which the person placed undertakes to provide in exchange for hospitality, the proposed hours of work, the amount of pocket-money, that a weekly holiday will be granted, that facilities to improve knowledge of the language will be granted, the period of the agreement and the cancellation conditions (Article 11).
Article 8 – Obligations of the receiving family
This article sets forth, in four paragraphs, the main obligations which each family receiving an "au pair" person must observe in regard to that person. The obligations are, inter alia
- board and lodging (paragraph 1) ;

- provision of free time for linguistic, cultural and professional improvement (paragraph 2) ;
- the weekly "day off" (paragraph 3)
- pocket-money (paragraph 4).

Paragraph 1
The two principal benefits to be provided by the receiving family are: board and lodging in the family's home. In view of the housing situation in towns, the negotiators did not wish to make it obligatory to provide a separate room although every effort should be made to do so.

Paragraph 2
In defining the educational activities of the "au pair" person, the word "improvement" was used to show that there could be no question of his pursuing a professional activity or full-length training course. The fact that those concerned are given the opportunity to pursue cultural activities and studies rules out the possibility of clandestine work.
Since placement is not necessarily effected in towns where organised courses area held, the negotiators refrained from too strict a formula - e.g. one making it compulsory to register for courses.

Paragraph 3
The granting of a full free day per week, not less than one such free day every month being a Sunday, laid down by this clause should be considered to be the minimum.

Paragraph 4
This clause concerns "pocket-money" ; the term was used purposely in order to prevent the sum to be paid from being considered as a remuneration or a wage. It should be noted that the negotiators abstained from specifying the amount of pocket-money. It was found impossible to give guidance as to the amount, which varies with the customs of the countries and the mutual services rendered. Obviously, if families take "au pair" persons to the theatre, cinema etc., and do not leave them to their own devices on the weekly free day provided for, less pocket-money will be needed. Here again, what is important is that the situation be clearly defined between the two parties at the beginning of the placement.


Article 9 – Services to be rendered by the "au pair" person

Under the terms of this article, the services which the "au pair" person must render the receiving family consist of «participation in day-to-day family duties", that is to say, in particular, housework, cooking, looking after the children.

At one stage, it was suggested that Article 9 specify that "heavy work", such as window-cleaning, laundry etc., were excluded from day-to-day family duties required of the "au pair" person. However, the negotiators of the Agreement did not adopt that proposal because it appeared too difficult to assess such work. Indeed, most "heavy work" can be done nowadays by machines, which modifies its nature.

It was agreed that the services required of the "au pair" person could include looking after children, even at night.
It was considered that the time given to "day-to-day family duties" should, in principle, be limited to five hours a day.


Article 10 – Social security

This article, in three paragraphs, guarantees any "au pair" person the appropriate benefits in the case of illness, maternity and accident.


Its text is a compromise between several schools of thought, for, although all delegations unanimously agreed during the preparatory work that social protection was essential, opinion varied as to how it should be provided.

The difficulty arose especially from the fact that in the absence of wages, affiliation to a national social security scheme was impossible in the majority of countries.


The following were the main viewpoints expressed

- firstly, Article 10 ought to have laid down the principle that the social security scheme of the receiving country should be automatically applied, except where the risks of sickness, maternity and accident are not covered by such a scheme, in which case the receiving family should contract a private insurance;

- the article should be based on the principle of equality of treatment and lay down that, in so far as a person placed "au pair" is not covered by national legislation or by an official or appointed body, the receiving family should contract an equivalent private insurance at its own expense ;

- finally, it would have been preferable to insert first a clause providing for the "au pair" person to be insured against the three risks previously mentioned, then to indicate how that insurance should be guaranteed and finally add an annex to the Agreement specifying the common minimum of the benefit to which he would be entitled.

The text of Article 10, which is a compromise between those various views, is adapted to cover both situations where "au pair" persons are eligible for the social security benefits of the country in which they are placed, and situations where no such scheme is applicable to them.

The first paragraph states that at the time the Agreement is signed, or subsequently (cf. Article 19), each Contracting State will set out in Annex I to the Agreement the benefits, irrespective of their nature, guaranteed within its territory (benefits under an official contributory scheme, under an official non-contributory scheme, or from private insurance etc.) and, in the second paragraph, it gives the essential arrangement to be made ; the third paragraph provides the possibility of subsequently modifying the list of benefits set out in the above-mentioned Annex 1.

Paragraph 1
It is provided here that the annex to the Agreement shall contain a list of benefits guaranteed within the territory of each Contracting State. In accordance with the Protocol to the Agreement, a notification listing the said benefits is made entirely on the responsibility of the notifying State. The Protocol also specifies that "as far as possible" those benefits shall include medical, pharmaceutical and hospitalisation expenses, such protection being considered to be a minimum.

Paragraph 2
This paragraph lays down the essential arrangement to be made for protecting "au pair" persons in those States where benefits set forth in Annex I to the Agreement are not guaranteed at all or only partially guaranteed by an official scheme or organisation : in such cases, "the competent member of the receiving family shall, at his own expense, take out a private insurance". But each Contracting Party may enter a reservation to the effect that only half the cost shall be borne by the receiving family (cf. Annex II (c)).
Such private insurance, where applicable, will provide as a minimum the guarantees set out in Annex I to the Agreement and, as stated above, will comprise, as far as possible, reimbursement of medical, pharmaceutical and hospitalisation expenses (cf. also : the Protocol attached to the Agreement).

The phrase "taking into account the provisions of inter- national agreements or the Regulations of the European Communities" was inserted to ensure that the clause was without prejudice to the said Agreements or Regulations : i.e. implementation would not be prejudicial to the scope of those instruments, which should, therefore, prevail.
During the preparatory work, it was stated that the term "official schemes" in this paragraph referred, for example, to the National Health Service in the United Kingdom.

Paragraph 3
It follows from. the text of this paragraph, taken in conjunction with Article 19, paragraph 2 and Article 21 sub-paragraph (i), that the notification for which it provides shall be addressed to the Secretary General of the Council of Europe who will inform all the Members of the Organisation as well as any other State that may accede to the Agreement.
Article 11 – Cancellation of the placement agreement
This article gives the possibilities for cancelling the written agreement mentioned in Article 6 of the Agreement.

The first paragraph deals solely with terminating a contract concluded for an indefinite period, in which case two weeks' notice shall be given.

Paragraph 2 concerns cancellation of an agreement concluded either for an unspecified or for a specified period and provides for the possibility of immediate termination (that is to say without notice) by one of the parties in the event of serious misconduct by the other, or if other serious circumstances so require.

The use of the expression "shall be entitled to terminate" and "may be terminated" appearing in paragraphs 1 and 2 respectively of Article 11 shows that cancellation is not obligatory, but is merely an option open under certain circumstances.

At one stage of the preparatory work, it was intended to make it obligatory for the receiving family to inform the local and consular authorities, and the parents of the "au pair" person of his disappearance, or of any breach of the written contract mentioned in Article 6. Ultimately, however, such obligation was not prescribed since the majority of the negotiators considered it was a general matter which could be left to the discretion of the receiving families.

Paragraph 1
In the case of a contract concluded for an unspecified period, it should be pointed out that each party to the placement agreement, that is to say either the "au pair" person or the receiving family, may terminate it under this clause without being obliged to give any reason. The same may obviously apply to an agreement concluded for a specified period, and extended for an indefinite period ; in which case, however, termination by virtue of this paragraph can take effect only during the extension period.

Paragraph 2
According to this clause, the placement agreement mentioned in Article 6 of the Agreement "may be terminated with immediate effect :
(a) in the event of "serious misconduct" by one of the parties, and
(b) in the event of "other serious circumstances".
In the case of (a), the option to terminate lies with the other party. On the other hand, in the case of (b), both parties have that option. The hypothesis (b) covers, among other things, cases of force majeure.


Article 12 – Institutions entitled to deal with "au pair" placement

Article 12 was included in the Agreement because it is important to see that in each Contracting State only reliable organisations are concerned with "au pair" placement.

The phrase "shall appoint" was used to show that, subject to the general scope of the undertakings under this Agreement (cf. especially Article 1), the competent authority in each Contracting State would be obliged to appoint the "public bodies" mentioned in Article 12. It would also have the option of appointing "private bodies", for example, welfare societies or charities, with branches throughout the country and able, therefore, to take rapid action.

One of the functions of such public or private bodies may be to act as depositories for the written agreement mentioned in Article 6 (2). Their other tasks may include the general supervision of placement conditions, checking whether the written agreements deposited are in order, settling differences between "au pair" persons and receiving families, consultations etc.

Article 12 does not compel the Contracting States to communicate a list of appointed bodies to the Council of Europe, but the Council nevertheless has the possibility of being informed of them through the application of Article 13 and can, therefore, ensure wide circulation of national lists and thus facilitate the information of all concerned.

A reservation to Article 12 will be accepted (cf. Annex II (d)) in view of that fact that in some countries the listing of bodies concerned with "au pair" placement and the procedures for appointing them will inevitably take time. However, it is understood that the implementation of the clause may be deferred only for the strictly necessary period.


Article 13 – Five-yearly reports

By virtue of this article, each Contracting State undertakes to submit every five years to the Committee of Ministers a report on the application of Articles 1 to 12.

The third paragraph is of particular importance. It is in fact dynamic in purport inasmuch as it provides that the Social Committee of the Council of Europe "may also make any proposals designed to... improve the practical implementation... (of the Agreement, and to) ... amend or supplement its provisions ...".


Articles 14, 15, 16 and 17

These articles are the standard final clauses approved by the Committee of Ministers of the Council of Europe.

As regards paragraph 1 of Article 16, preference was given to an open Agreement because its scope of application was not restricted solely to nationals of member States of the Council of Europe.


Article 18

In accordance with Article 18, each signatory State, as well as each acceding State, has the right to make use of one or more of the four reservations, the texts of which are given in Annex II to the Agreement. No other reservation is allowed.

It should also be pointed out that Article 18 does not contain the usual reciprocity clause as it would be incompatible with the general character of the Agreement, which is not of the type to create reciprocal undertakings ; moreover, it would have been in contradiction with the field of application ratione personae of the Agreement since it is not limited solely to nationals of the Contracting States (cf. above : comments on Articles 2 and 16).

Die Mitgliedsstaaten des Europarats, die dieses Übereinkommen unterzeichnen, in der Erwägung, dass es das Ziel des Europarats ist, eine engere Verbindung zwischen seinen Mitgliedern herbeizuführen, insbesondere zur Förderung ihres sozialen Fortschritts;
im Hinblick darauf, dass in Europa eine ständig zunehmende Zahl von Jugendlichen, vornehmlich Mädchen, sich ins Ausland begeben, um eine Au-pair-Beschäftigung aufzunehmen;

in der Erwägung, dass es, ohne dass ein Werturteil zu dieser weitverbreiteten Übung abgegeben werden soll, angebracht ist, die Bedingungen für eine Au-pair-Beschäftigung in allen Mitgliedstaaten festzulegen und zu vereinheitlichen;

in der Erwägung, dass die Au-pair-Beschäftigung in den Mitgliedstaaten ein bedeutendes soziales Problem mit juristischen, ethischen, kulturellen und wirtschaftlichen Begleiterscheinungen aufwirft, das weit über den nationalen Rahmen hinausgeht und damit europäischen Charakter annimmt;

in der Erwägung, dass die Au-pair-Beschäftigten weder der Gruppe der Studierenden noch der Gruppe der Arbeitnehmer angehören, sondern einer besonderen Gruppe, die Züge von beiden trägt, und dass es daher sinnvoll ist, für sie geeignete Regelungen vorzusehen;

in besonderer Anerkennung der Notwendigkeit, den Au-pair-Beschäftigten einen angemessenen sozialen Schutz zu gewährleisten, der sich nach den in der Europäischen Sozialcharta verankerten Grundsätzen richtet;

in der Erwägung, dass viele dieser Personen Minderjährige sind, die während einer langen Zeitspanne die Unterstützung ihrer Familie entbehren müssen, und daß sie daher besonderen Schutz hinsichtlich der materiellen und sittlichen Verhältnisse im Gastland genießen müssen;

in der Erwägung, dass allein die staatlichen Behörden voll in der Lage sind, die Verwirklichung dieser Grundsätze und die Überwachung ihrer Anwendung sicherzustellen;

überzeugt von der Notwendigkeit einer solchen Koordinierung im Rahmen des Europarats, sind wie folgt übereingekommen:


Artikel 1

Jede Vertragspartei verpflichtet sich, in ihrem Hoheitsgebiet die Durchführung der Bestimmungen dieses Übereinkommens in größtmöglichem Umfang zu fördern.


Artikel 2

1.    Die Au-pair-Beschäftigung besteht in der zeitlich begrenzten Aufnahme junger Ausländer, die gekommen sind, um ihre Sprachkenntnisse und gegebenenfalls ihre Berufserfahrung zu vervollkommnen und ihre Allgemeinbildung durch eine bessere Kenntnis des Gastlands zu erweitern, durch Familien im Austausch für bestimmte Leistungen.
2.    Diese jungen Ausländer werden im Folgenden als "Au-pair-Beschäftigte" bezeichnet.


Artikel 3

Die Au-pair-Beschäftigung, deren Dauer zunächst nicht mehr als ein Jahr betragen darf, kann jedoch auf eine Dauer von bis zu zwei Jahren verlängert werden.


Artikel 4

1.    Au-pair-Beschäftigte dürfen nicht jünger als 17 Jahre und nicht älter als 30 Jahre sein.
2.    Jedoch kann die zuständige Behörde des Gastlands ausnahmsweise auf begründeten Antrag Abweichungen in Bezug auf die obere Altersgrenze gewähren.


Artikel 5

Der Au-pair-Beschäftigte braucht ein ärztliches Zeugnis, das weniger als drei Monate vor der Aufnahme in der Gastfamilie ausgestellt wurde und Angaben über den allgemeinen Gesundheitszustand enthält.


Artikel 6

1.    Die Rechte und Pflichten des Au-pair-Beschäftigten und der Gastfamilie, wie sie in diesem Übereinkommen festgelegt sind, sind Gegenstand eines schriftlichen Vertrags, der zwischen den beteiligten Parteien in Form eines Einzelschriftstücks oder eines Briefwechsels zu schließen ist, und zwar möglichst vor der Ausreise des Au-pair-Beschäftigten aus dem Land, in dem er seinen Wohnort hat, spätestens aber in der ersten Woche nach der Aufnahme in der Gastfamilie.
2.    Eine Ausfertigung des in Absatz 1 vorgesehenen Vertrags wird im Gastland bei der zuständigen Behörde oder bei der von ihr benannten Stelle hinterlegt.


Artikel 7

Der in Artikel 6 vorgesehene Vertrag legt insbesondere die Bedingungen fest, unter denen der Au-pair-Beschäftigte am Leben der Gastfamilie teilhaben soll, wobei er einen gewissen Grad an Unabhängigkeit genießen soll.


Artikel 8

1.    Der Au-pair-Beschäftigte erhält von der Gastfamilie Unterkunft und Verpflegung; er bewohnt nach Möglichkeit ein eigenes Zimmer.
2.    Der Au-pair-Beschäftigte verfügt über genügend Zeit, um Sprachkurse zu besuchen und sich kulturell und beruflich weiterzubilden; zu diesem Zweck werden ihm alle Erleichterungen bei der Zeitplanung gewährt.
3.    Dem Au-pair-Beschäftigten steht mindestens ein voller freier Tag wöchentlich zu, wobei wenigstens ein solcher Tag im Monat auf einen Sonntag fallen muss; er muss uneingeschränkt Gelegenheit zur Teilnahme an der Religionsausübung erhalten.
4.    Der Au-pair-Beschäftigte erhält einen bestimmten Betrag als Taschengeld, dessen Höhe und Auszahlungstermine durch den in Artikel 6 vorgesehenen Vertrag festgesetzt werden.


Artikel 9

Der Au-pair-Beschäftigte erbringt Leistungen für die Familie, die in der Mitwirkung an der Erfüllung der täglichen häuslichen Pflichten bestehen. Grundsätzlich darf die tatsächlich für diese Leistungen aufgewendete Zeit fünf Stunden täglich nicht überschreiten.


Artikel 10

1.    Jede Vertragspartei gibt die Leistungen an, die jedem Au-pair-Beschäftigten in ihrem Hoheitsgebiet bei Krankheit, Mutterschaft oder Unfall zugesichert sind, und führt sie in Anhang I dieses Übereinkommens auf.
2.    Falls und soweit die in Anhang I aufgeführten Leistungen im Gastland nicht durch ein staatliches System der Sozialen Sicherheit oder andere amtliche Systeme sichergestellt werden können, wobei die Bestimmungen internationaler Übereinkünfte oder die Vorschriften der Europäischen Gemeinschaften zu berücksichtigen sind, schließt das zuständige Mitglied der Gastfamilie eine private Versicherung ab, die voll zu seinen Lasten geht.
3.    Jede Änderung der Liste der Leistungen in Anhang I wird von jeder Vertragspartei nach Artikel 19 Absatz 2 notifiziert.


Artikel 11

1.    Wurde der in Artikel 6 vorgesehene Vertrag auf unbestimmte Zeit geschlossen, so ist jede Partei berechtigt, ihn unter Einhaltung einer zweiwöchigen Kündigungsfrist zu beenden.
2.    Unabhängig davon, ob der Vertrag auf bestimmte oder unbestimmte Zeit geschlossen wurde, kann er von jeder Partei im Fall eines schweren Fehlverhaltens der anderen Partei oder wenn andere schwerwiegende Umstände es erfordern, mit sofortiger Wirkung gekündigt werden.


Artikel 12

Die zuständige Behörde jeder Vertragspartei bestimmt die öffentlichen Stellen und kann die privaten Stellen bestimmen, die zur Au-pair-Vermittlung befugt sind.


Artikel 13

1.    Jede Vertragspartei legt dem Generalsekretär des Europarats alle fünf Jahre in einer vom Ministerkomitee zu bestimmenden Form einen Bericht über die Anwendung der Artikel 1 bis 12 vor.
2.    Die Berichte der Vertragsparteien werden dem Sozialausschuß des Europarats zur Prüfung unterbreitet.
3.    Der Sozialausschuß legt dem Ministerkomitee einen Bericht mit seinen Schlußfolgerungen vor; er kann außerdem jede Art von Vorschlägen machen:
i.    die auf eine Verbesserung der praktischen Durchführung dieses Übereinkommens gerichtet sind;
ii.    die auf eine Änderung oder Ergänzung dieses Übereinkommens gerichtet sind.


Artikel 14

1.    Dieses Übereinkommen liegt für die Mitgliedsstaaten des Europarats zur Unterzeichnung auf; sie können Vertragsparteien werden:
a.    indem sie es ohne Vorbehalt der Ratifikation oder Annahme unterzeichnen;
b.    indem sie es vorbehaltlich der Ratifikation oder Annahme unterzeichnen und später ratifizieren oder annehmen.
2.    Die Ratifikations- oder Annahmeurkunden werden beim Generalsekretär des Europarats hinterlegt.


Artikel 15

1.    Dieses Übereinkommen tritt einen Monat nach dem Tag in Kraft, an dem drei Mitgliedsstaaten des Europarats nach Artikel 14 Vertragsparteien geworden sind.
2.    Für jeden Mitgliedstaat, der es später ohne Vorbehalt der Ratifikation oder Annahme unterzeichnet oder der es ratifiziert oder annimmt, tritt das Übereinkommen einen Monat nach dem Tag der Unterzeichnung oder der Hinterlegung der Ratifikations- oder Annahmeurkunde in Kraft.


Artikel 16

1.    Nach Inkrafttreten dieses Übereinkommens kann das Ministerkomitee des Europarats jeden Nichtmitgliedstaat des Rates einladen, dem Übereinkommen beizutreten.
2.    Der Beitritt erfolgt durch Hinterlegung einer Beitrittsurkunde beim Generalsekretär des Europarats und wird einen Monat nach deren Hinterlegung wirksam.


Artikel 17

1.    Jeder Unterzeichnerstaat kann bei der Unterzeichnung oder bei der Hinterlegung seiner Ratifikations- oder Annahmeurkunde und jeder beitretende Staat kann bei der Hinterlegung seiner Beitrittsurkunde einzelne oder mehrere Hoheitsgebiete bezeichnen, auf die dieses Übereinkommen Anwendung findet.

2.    Jeder Unterzeichnerstaat kann bei der Hinterlegung seiner Ratifikations- oder Annahmeurkunde oder jederzeit danach und jeder beitretende Staat kann bei der Hinterlegung seiner Beitrittsurkunde oder jederzeit danach die Anwendung dieses Übereinkommens durch eine an den Generalsekretär des Europarats gerichtete Erklärung auf jedes weitere in der Erklärung bezeichnete Hoheitsgebiet erstrecken, dessen internationale Beziehungen er wahrnimmt oder für das er Verpflichtungen eingehen kann.

3.    Jede nach Absatz 2 abgegebene Erklärung kann in bezug auf jedes darin bezeichnete Hoheitsgebiet zu den in Artikel 20 vorgesehenen Bedingungen zurückgenommen werden.


Artikel 18

1.    Jeder Unterzeichnerstaat kann bei der Unterzeichnung oder bei der Hinterlegung seiner Ratifikations- oder Annahmeurkunde und jeder beitretende Staat kann bei der Hinterlegung seiner Beitrittsurkunde erklären, daß er von einem oder mehreren der in Anlage II dieses Übereinkommens vorgesehenen Vorbehalte Gebrauch macht. Weitere Vorbehalte sind nicht zulässig.
2.    Jeder Unterzeichnerstaat oder jede Vertragspartei kann einen von ihm oder ihr nach Absatz 1 angebrachten Vorbehalt durch eine an den Generalsekretär des Europarats gerichtete Erklärung ganz oder teilweise zurücknehmen; die Erklärung wird mit ihrem Eingang wirksam.


Artikel 19

1.    Jeder Unterzeichnerstaat gibt bei der Unterzeichnung oder bei der Hinterlegung seiner Ratifikations- oder Annahmeurkunde und jeder beitretende Staat gibt bei der Hinterlegung seiner Beitrittsurkunde die nach Artikel 10 Absatz 1 in Anlage I aufzuführenden Leistungen bekannt.

2.    Jede in Artikel 10 Absatz 3 vorgesehene Notifikation wird unter Angabe des Tages, an dem sie wirksam wird, an den Generalsekretär des Europarats gerichtet.


Artikel 20

1.    Dieses Übereinkommen bleibt auf unbegrenzte Zeit in Kraft.
2.    Jede Vertragspartei kann für sich selbst dieses Übereinkommen durch Notifikation an den Generalsekretär des Europarats kündigen.
3.    Die Kündigung wird sechs Monate nach Eingang der Notifikation beim Generalsekretär wirksam.


Artikel 21

Der Generalsekretär des Europarats notifiziert den Mitgliedstaaten des Rates und jedem Staat, der diesem Übereinkommen beigetreten ist:

a.    jede Unterzeichnung ohne Vorbehalt der Ratifikation oder Annahme;
b.    jede Unterzeichnung vorbehaltlich der Ratifikation oder Annahme;
c.    jede Hinterlegung einer Ratifikations-, Annahme- oder Beitrittsurkunde;
d.    die in Anlage I aufgeführten Leistungen;
e.    jeden Zeitpunkt des Inkrafttretens dieses Übereinkommens nach seinem Artikel 15;
f.    jede nach Artikel 17 Absätze 2 und 3 eingegangene Erklärung;
g.    jeden nach Artikel 18 Absatz 1 angebrachten Vorbehalt;
h.    die Rücknahme jedes Vorbehalts nach Artikel 18 Absatz 2;
i.    jede nach Artikel 19 Absatz 2 eingegangene Notifikation;
j.    jede nach Artikel 20 eingegangene Notifikation und den Zeitpunkt, zu dem die Kündigung wirksam wird.


Artikel 22

Das diesem Übereinkommen beigefügte Protokoll ist Bestandteil des Übereinkommens.

Zu Urkund dessen haben die hierzu gehörig befugten Unterzeichneten dieses Übereinkommen unterschrieben.

Geschehen zu Straßburg am 24. November 1969 in englischer und französischer Sprache, wobei jeder Wortlaut gleichermaßen verbindlich ist, in einer Urschrift, die im Archiv des Europarats hinterlegt wird. Der Generalsekretär des Europarats übermittelt allen Unterzeichnerstaaten und allen beitretenden Staaten beglaubigte Abschriften.


Protokoll
(Artikel 10)
1.    Jede Vertragspartei gibt in eigener Verantwortung die Erklärung in Anlage I ab und nimmt eigenverantwortlich spätere Änderungen vor.
2.    Die in Anlage I aufgeführten Leistungen müssen nach Möglichkeit die Kosten für ärztliche Behandlung, Medikamente und Krankenhausaufenthalt decken.

Jede Vertragspartei kann erklären, dass sie sich das Recht vorbehält:
a.    den Ausdruck "Au-pair-Beschäftigter" nur auf Personen weiblichen Geschlechts anzuwenden;
b.    von den beiden in Artikel 6 Absatz 1 festgelegten Möglichkeiten nur diejenige zuzulassen, die vorsieht, dass der Vertragsabschluss erfolgen muss, bevor der Au-pair-Beschäftigte das Land, in dem er seinen Wohnort hat, verlässt;
c.    von Artikel 10 Absatz 2 insofern abzuweichen, als die Beiträge zur privaten Versicherung zur Hälfte von der Gastfamilie zu tragen sind und diese Abweichung jedem, der eine Au-pair-Beschäftigung aufnehmen will, vor Abschluss des Vertrags zur Kenntnis zu bringen ist;
d.    die Durchführung des Artikels 12 so lange zu verschieben, bis die zu dieser Durchführung erforderlichen praktischen Maßnahmen getroffen sind, wobei davon ausgegangen wird, dass sie sich bemühen wird, diese Maßnahmen so bald wie möglich zu ergreifen.

    Regardless of whether the period concerned is specified or not in the event of serious misconduct by one of the parties, the other party may immediately terminate the agreement. Either of the parties may also terminate the agreement with immediate effect if serious circumstances make such instant termination necessary.

1 According to Article 3 of the European Agreement on Au Pair Placement, the initial period shall net exceed one year but may be extended to permit of -a maximum stay of two years. Where the agreement has been concluded for an unspecified period, either party shall be entitled to terminate it by giving two weeks' notice.

According to Article 6 of the European Agreement on Au Pair Placement, the present agreement should be concluded preferably before the person au pair leaves the country in which she/he was resident and at latest during the first week of the placement.

According to Article 8, paragraph 1, of the European Agreement on Au Pair Placement, the au pair shall, where possible, occupy a separate room.

4 According to Article 8, paragraph 3, of the European Agreement on Au Pair Placement, the au. pair shall have at least one full free day pet week, not less than one such free day in every month being a Sunday.

5 The Protocol to the European Agreement provides that in the event of sickness, maternity, and accident benefits shall cover, as far as possible, the cost of medical treatment, pharmacy and hospital care.

6 The possibility of making the au pair responsible for half the insurance premiums can only exist where a Contracting Party has made a reservation on this point at the time of ratification of the European Agreement on Au Pair Placement.

7 According to Article 9 of the European Agreement on Au Pair Placement, the time effectively occupied in such services shall generally not be more than five hours per day.

8 According to Article 5 of the -European Agreement on Au Pair Placement, the au pair's medical certificate shall have been established less than three months before placement and shall declare her/his general state of health.

EUROPEAN AGREEMENT ON AU PAIR PLACEMENT

Strasbourg, 24.XI.1969
 


The member States of the Council of Europe, signatory hereto,

Considering that the aim of the Council of Europe is to achieve greater unity between its members, in particular for the purpose of facilitating their social progress;

Noting that in Europe more and more young persons, especially girls, are going abroad to be placed “au pair”;
 
Considering that, without wishing to make any critical assessment of this widespread practice, it is advisable to define and standardise, in all member States, the conditions governing such “au pair” placement;
 
Considering that “au pair” placement constitutes in member States an important social problem with legal, moral, cultural and economic implications, which transcends national boundaries and thereby takes on a European complexion;
 
Considering that persons placed “au pair” belong neither to the student category nor to the worker category but to a special category which has features of both, and that therefore it is useful to make appropriate arrangements for them;
 
Acknowledging more particularly the need to give persons placed “au pair” adequate social protection inspired by the principles laid down in the European Social Charter;
 
Considering that many of these persons are minors deprived for a long period of the support of their families, and that as such they should receive special protection relating to the material or moral conditions found in the receiving country;
 
Considering that only the public authorities can fully ensure and supervise the implementa¬tion of these principles;
 
Being convinced of the need for such co ordination within the framework of the Council of Europe,
 
Have agreed as follows:


Article 1

Each Contracting Party undertakes to promote in its territory to the greatest extent possible the implementation of the provisions of this Agreement.


Article 2

1    “Au pair” placement is the temporary reception by families, in exchange for certain services, of young foreigners who come to improve their linguistic and possibly professional knowledge as well as their general culture by acquiring a better knowledge of the country where they are received.

2    Such young foreigners are hereinafter called persons placed “au pair”.


Article 3

Placement “au pair” which shall initially be for a period not exceeding one year, may, however, be extended to permit of a maximum stay of two years.


Article 4

1    The person placed “au pair” shall not be less than 17 or more than 30 years of age.

2    Nevertheless, exceptions to the upper age limit may be granted by the competent authority of the receiving country in indi¬vidual cases when justified.


Article 5

The person placed “au pair” shall have a medical certifi¬cate, established less than three months before placement, declaring that person's general state of health.


Article 6

1    The rights and obligations of the person “au pair” and the receiving family, as those rights and obligations are defined in this Agreement, shall be the subject of an agreement in writing to be concluded between the parties in question, in the form of a single document or of an exchange of letters, preferably before the person placed “au pair” leaves the country in which that person was resident and at latest during the first week of the placement

2    A copy of the agreement referred to in the preceding paragraph shall be lodged in the receiving country with the competent authority or the organisation chosen by this authority.


Article 7

The agreement referred to in Article 6 shall specify inter alia the manner in which the person placed “au pair” is to share the life of the receiving family, while at the same time enjoying a certain degree of independence.


Article 8

1    The person placed “au pair” shall receive board and lodging from the receiving family and, where possible, shall occupy a separate room.

2    The person placed “au pair” shall be given adequate time to attend language courses as well as for cultural and professional improvement; every facility as regards the arrangement of working hours shall be accorded to this end.

3    The person placed “au pair” shall have at least one full free day per week, not less than one such free day in every month being a Sunday, and shall have full opportunity to take part in religious worship.

4    The person placed “au pair” shall receive a certain sum of money, as pocket money, the amount of which and the intervals at which it is paid shall be determined by the agreement referred to in Article 6.


Article 9

A person placed “au pair” shall render the receiving family services consisting in participation in day to day family duties. The time effectively occupied in such services shall generally not be more than five hours per day.


Article 10

1    Each Contracting Party shall state, by listing them in Annex I to this Agreement, the benefits to which a person placed “au pair” will be entitled within its territory in the event of sickness, maternity or accident.

2    If and in so far as the benefits listed in Annex I cannot be covered, in the receiving country, by national social security legislation or other official schemes, taking into account the provisions of international agreements or the Regulations of the European Communities, the competent member of the receiving family shall, at his own expense, take out a private insurance.

3    Any change in the list of benefits in Annex I shall be notified by any Contracting Party in accordance with Article 19, para¬graph 2.


Article 11

1    Where the agreement referred to in Article 6 has been concluded for an unspecified period, either party shall be entitled to terminate it by giving two weeks' notice.

2    Whether the agreement was made for a specified period or not, it may be terminated with immediate effect by either party in the event of serious misconduct by the other party or if other serious circumstances make such instant termination necessary.


Article 12

The competent authority of each Contracting Party shall appoint the public bodies and may appoint the private bodies to be entitled to deal with “au pair” placement.


Article 13
1    Each Contracting Party shall send to the Secretary General of the Council of Europe a report at five yearly intervals, in a form to be determined by the Committee of Ministers, concerning the application of the provisions of Articles 1 to 12 of this Agreement.

2    The reports of the Contracting Parties shall be submitted for examination to the Governmental Social Committee of the Council of Europe.

3    The Governmental Social Committee shall present to the Committee of Ministers a report containing its conclusions; it may also make any proposals designed to:
i    improve the practical implementation of this Agreement;
ii    amend or supplement its provisions.
        

Article 14

1    This Agreement shall be open to signature by the member States of the Council of Europe, who may become Parties to it either by:
a    signature without reservation in respect of ratification or acceptance, or
b    signature with reservation in respect of ratification or acceptance, followed by ratification or acceptance.

2    Instruments of ratification or acceptance shall be deposited with the Secretary General of the Council of Europe.

        
Article 15


1    This Agreement shall enter into force one month after the date on which three member States of the Council shall have become Parties to the Agreement, in accordance with the provisions of Article 14.

2    As regards any member States who shall subsequently sign the Agreement without reservation in respect of ratification or acceptance or who shall ratify or accept it, the Agreement shall enter into force one month after the date of such signature or after the date of deposit of the instrument of ratification or acceptance.

        
Article 16


1    After the entry into force of this Agreement, the Committee of Ministers of the Council of Europe may invite any non member State to accede thereto.

2    Such accession shall be effected by depositing with the Secretary General of the Council of Europe an instrument of accession which shall take effect one month after the date of its deposit.

        
Article 17

1    Any signatory State, at the time of signature or when depositing its instrument of ratification or acceptance, or any acceding State, when depositing its instrument of accession, may specify the territory or territories to which this Agreement shall apply.

2    Any signatory State, when depositing its instrument of ratification or acceptance or at any later date, or any acceding State, when depositing its instrument of accession or at any later date, by declaration addressed to the Secretary General of the Council of Europe, may extend this Agreement to any other territory or territories specified in the declaration and for whose international relations it is responsible or on whose behalf it is authorised to give undertakings.

3    Any declaration made in pursuance of the preceding paragraph may, in respect of any territory mentioned in such declaration, be withdrawn according to the procedure laid down in Article 20 of this Agreement.
 
        
Article 18


1    Any signatory State, at the time of signature or when depositing its instrument of ratification or acceptance, or any acceding State when depositing its instrument of accession, may declare that it avails itself of one or more of the reservations provided for in Annex II to this Agreement. No other reservation shall be admissible.

2    Any signatory State or any Contracting Party may wholly or partly withdraw a reservation it has made in accordance with the foregoing paragraph by means of a declaration addressed to the Secretary General of the Council of Europe which shall become effective as from the date of its receipt.

        
Article 19


1    Any signatory State, at the time of signature or when depositing its instrument of ratification or acceptance, or any acceding State when depositing its instrument of accession, shall make known the benefits to be listed at Annex I in accordance with the provisions of paragraph 1 of Article 10.

2    Any notification referred to in paragraph 3 of Article 10 shall be addressed to the Secretary General of the Council of Europe and shall state the date from which it takes effect.

        
Article 20


1    This Agreement shall remain in force indefinitely.

2    Any Contracting Party may, in so far as it is concerned, denounce this Agreement by means of a notification addressed to the Secretary General of the Council of Europe.

3    Such denunciation shall take effect six months after the date of receipt by the Secretary General of such notifica¬tion.

        
Article 21

The Secretary General of the Council of Europe shall notify the member States of the Council and any State which has acceded to this Agreement of:

        a    any signature without reservation in respect of ratifica¬tion or acceptance;

        b    any signature with reservation in respect of ratification or acceptance;

        c    the deposit of any instrument of ratification, acceptance or acces¬sion;

        d    the lists of benefits listed at Annex I;

        e    any date of entry into force of this Agreement in accordance with Article 15 thereof:

        f    any declaration received in pursuance of the provi¬sions of paragraphs 2 and 3 of Article 17;

        g    any reservation made in pursuance of the provisions of paragraph 1 of Article 18;

        h    the withdrawal of any reservation carried out in pursu¬ance of the provisions of paragraph 2 of Article 18;

        i    any notification received in pursuance of the provisions of paragraph 2 of Article 19;

        j    any notification received in pursuance of the provisions of Article 20 and the date on which denunciation takes effect.

        
Article 22

The Protocol attached to this Agreement shall form an inte¬gral part of it.

In witness whereof the undersigned, being duly authorised thereto, have signed this Agreement.
 
Done at Strasbourg, this 24th day of November 1969, in English and French, both texts being equally authoritative, in a single copy which shall remain deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall trans¬mit certified copies to each of the signatory and acced¬ing States.

ANNEX II
(Article 18.1)

Reservations

Any Contracting Party may declare that it reserves the right:

a    to consider that the term “person placed `au pair'” shall apply only to females;

b    to adopt, of the two methods specified in Article 6, paragraph 1, only that which lays down that the agreement in writing shall be concluded before the person placed “au pair” leaves the country in which that person was resident;

c    to derogate from the provisions of Article 10, paragraph 2, in so far as one half of any private insurance premiums would be covered by the receiving family and in so far as this derogation would be brought, before the conclusion of the agreement, to the attention of any person interested in an “au pair” placement;

d    to defer implementation of the provisions of Article 12 until it has been able to make the necessary practical arrangements for such implementation, on the understanding that it shall endeavour to make these arrangements as soon as possible.
